End User License Agreement (EULA)

This End User License Agreement (“Agreement”) governs the use of the TRAILFLOW software product, including the Recording Agent and Trail Verifier modules (collectively, the “Software”). By installing, accessing, or using the Software, the user agrees to be bound by the terms of this Agreement.

1. License Grant

TRAILFLOW grants a limited, non-exclusive, non-transferable, revocable license to use the Software for internal business purposes, subject to the terms of this Agreement.

The Software is licensed, not sold.

6. No Legal Certification

The Software provides technical recording and verification capabilities. It does not provide legal certification, legal compliance guarantees, or evidentiary validation under any jurisdiction.

Customers are responsible for determining whether recordings meet their legal, regulatory, or internal compliance requirements.

Support is provided according to the TRAILFLOW Support Policy available on the website.

Additional support or maintenance services may be provided under separate agreement.

9. Warranty Disclaimer

The Software is provided “as is” without warranties of any kind, express or implied, including but not limited to fitness for a particular purpose, merchantability, or non-infringement.

10. Limitation of Liability

To the maximum extent permitted by law, TRAILFLOW shall not be liable for any indirect, incidental, special, or consequential damages, including loss of data, business interruption, or loss of profits arising from the use or inability to use the Software.

12. Governing Law

This Agreement shall be governed by and interpreted in accordance with the laws of Luxembourg. Any disputes arising from or in connection with this Agreement shall be subject to the jurisdiction of the courts of Luxembourg.

13. Entire Agreement

This Agreement constitutes the entire agreement between the parties regarding the use of the Software and supersedes any prior agreements or understandings.
